Licence Chooser
AusGOAL supports information management best practice by identifying and managing legal risks associated with making information available for re-use. Licence Chooser directs you to consider factors such as nested copyrights, privacy, security and confidentiality associated with the release of the material. It includes the following steps:
-
The identification of the material to be licensed.
-
The identification and review of any restrictions applicable to the original content. (Original content is that which is unique and original to the material. It does not contain information from another source or sources.)
-
The identification of nested copyrights incorporated into the material.
-
The identification and review of publishing restrictions relating to the nested copyrights.
-
The selection of an appropriate licence based on the outcome of the Review.
Using Licence Chooser
Its not intended that you use Licence Chooser for every individual publication or dataset in your organisation. It is designed to support your licensing decision making process, and as your experience with copyright builds, your reliance upon the Licence Chooser will decrease. A more efficient use of Licence Chooser would be to consider your organisations information holdings in 'classes' or 'genre's'. Where a class of information has the same characteristics it may only be necessary to use the Licence Chooser once for that class.
Australian Government Agencies
If you work for a Commonwealth Government agency, Licence Chooser ensures that your licensing decision complies with the Commonwealth Attorney-Generals IP Principles, Guidelines and Manual, by preferring the CC-BY Licence where possible. Where its not possible to licence your material under CC-BY, Licence Chooser will tell you which alternative licence in the AusGOAL suite would be most appropriate.
Please note that Licence Chooser is not intended to apply to the licensing of software. AusGOAL recommends the BSD 3-Clause Software Licence, or an appropriate open source software licence for that purpose.
Other Features
Licence Chooser also allows you to print or save PDF files to record your progress, in addition to providing a Summary Report at the end as a record of your licensing decision. The Licence Chooser process is independent of your agency’s publication approval process. However, the Summary Report which is provided at the end of the Review process can be downloaded and included in your publishing approval process.
When you have selected an appropriate licence you can download a HTML snippet that can be placed on the webpage where the material is published. The HTML complies with the mandatory elements of the Australian Government Locator Service Standard (AGLS) and RDFa, and will enable your material to be more easily discovered on the Internet.
PLEASE NOTE: The Licence Chooser currently refers to the Version 2.5 Creative Commons Australia licences. This is because the new AusGOAL Licence Chooser tool is under construction. In the meantime, please regard any references to the Version 2.5 Creative Commons Australia Licences as being references to the Version 3.0 Creative Commons Australia Licences. With regard to the html code snippet referred to above, please replace 2.5 in the URL with 3.0, and the code will link to the version 3.0 licences.
